Damages for Unnecessary TVTO

M R Law has successfully recovered damages upon behalf of a woman who underwent an unnecessary TVTO (Tension Free Vaginal Tape Obdurate) procedure.

This is where a ribbon or tape is placed under the urethra to ensure it remains closed when pressure is placed on the bladder, such as during coughing, sneezing or even when walking. It is usually effective treatment in helping stop women leaking urine from their bladder.

However, it is not necessarily suitable treatment for all conditions and there should be a careful analysis of a patient’s complete symptoms before recommending the treatment.

On this occasion, the treatment was not suitable and only caused to worsen the patient’s condition, leaving her with severe urinary symptoms.

Robert Barker, head of Medical Negligence at M R Law comments: “These are difficult claims to pursue because nothing may have seemed to go wrong during the surgery, yet a patient is then left with severe ongoing problems possibly for the remainder of their life. A patient has to show that the surgeon was at fault for even recommending the operation.

Most patients already have severe symptoms even to undergo the surgery; therefore, it is never easy for them to show their condition has worsened after having the treatment. I am delighted for our client that we were able to achieve a positive outcome for what has become a severely debilitating condition for her.”
