Damages for complications arising from hysterectomy

M R Law has successfully recovered damages upon behalf of a woman who suffered damage to her ureter during a laparoscopic or keyhole hysterectomy.

Although seemingly well immediately following the operation, 2 days after her discharge from hospital and 6 days after the operation she developed severe diarrhoea and vomiting causing her readmission to hospital.

Twelve days following her original operation a urinary tract injury was diagnosed although her condition continued to deteriorate and she faced a prolonged stay in hospital before her eventual final discharge some 32 days after her hysterectomy.

The hospital accepted that the damage to the ureter should not have occurred and M R Law was able to obtain an advantageous settlement including losses of earnings for her prolonged stay in hospital and subsequent recuperation.

Robert Barker, head of Medical Negligence at M R Law comments: “Although damage to the ureter and/or bladder can be a recognised complication of this kind of surgery, the hospital accepted they were at fault in this instance.

The consequences for our client of the damage to her ureter were severe. She became extremely ill due to urine leaking into her body causing a severe infection. It took her a considerable period to recover from the physical symptoms and such a traumatic incident caused her understandable psychological distress.

It was pleasing that we were able to achieve some form of closure for the incident, albeit there remained a small risk in the future of complications arising from the original surgery.”
