Damages awarded for school grounds injury

M R Law has successfully recovered damages at court upon behalf of a man who suffered a leg injury despite a constant and persistent denial of responsibility by the insurance company representing the school.

The man worked as a courier and he was making a delivery to a school. As he was walking through the school grounds, he caught his leg on a broken flowerpot carelessly discarded by the school.

He suffered a large gash to his left requiring hospital treatment followed by a period of recuperation and he was left with a permanent scar.

The case was resolved at the Watford County Court with the judge finding in his favour despite the insurance company continuing to deny the school was responsible for the accident.

It would have been in everybody’s interest to resolve this claim at a much earlier stage, saving considerable time and money but upon our advice, our client was not prepared to accept their denials. ~Ann Mahone

Ann Mahoney, head of Personal Injury at M R Law comments: “Thankfully in this case, our client did not suffer severe injuries although he still had a scar that should not have arisen but for the dangerous condition of the school grounds.

The response of the insurance company was hugely disappointing. They continued to deny the school was responsible for the accident despite the clear evidence presented to them throughout. They denied responsibility all the way to a final hearing at court when the judge found in our client’s favour.

It would have been in everybody’s interest to resolve this claim at a much earlier stage, saving considerable time and money but upon our advice, our client was not prepared to accept their denials.

It shows the benefits of a thorough investigation into the facts, persisting with a claim and not just accepting an initial denial of responsibility by an insurance company.”
