Hairdresser wins claim against large hair product manufacturer

M R Law has successfully recovered damages on behalf of a hairdresser who suffered damage to her hair and scalp after using hair dye manufactured and sold by a world-renowned company.

After purchasing the product, she asked a colleague to apply the dye in accordance with the instructions but after her colleague removed the dye, her hair looked orange and it was badly damaged. She contacted the manufacturers who suggested the product should only be used on hair not previously dyed, unlike the Claimant’s hair. This warning did not appear on any of the packaging that came with the product.

Subsequently, the manufacturers recalled the dye from sale because of the problems experienced by the Claimant and other users.

Ann Mahoney, head of Personal Injury at M R Law who dealt with the case, comments, “This shows how problems can arise in the manufacturing and testing process, even for large, multi-national companies specialising in haircare products. Due to the way the product had been made and the inadequate instructions that came with it, our client suffered serious and long-term damage to her hair and scalp, causing her considerable distress, even more so because she is a hairdresser by trade.”

It may not always be obvious that a claim arises when an individual suffers damage to their hair, either by using a defective hair product or for some other reason. However, damage to hair often also causes emotional distress and upset to the person involved.

This claim was successfully resolved in our client’s favour with her accepting a good offer of settlement for the damage to her hair and her other losses, albeit only after some delay on the part of the manufacturers of the product.
