Time Factors
Time factors are important, whether it is how long it may take to conclude a case or whether there are any time limits in which to bring a claim.
Any competent and realistic lawyer will always inform a client that pursuing a claim for compensation can sometimes be a time-consuming and convoluted process.
We prefer to be open and upfront with all clients before they become involved in the claim’s process rather than providing an unrealistic timescale and leaving clients disappointed.
How long will it take to conclude my claim?
- Where an individual has been involved in an accident and sustained any kind of injury, on average, most claims can be resolved in 6 to 24 months.
- Claims involving medical or clinical negligence usually require a greater amount of investigation and a more realistic timescale is between 12 to 36 months.
- Much depends on the complexity of the case, the extent of the injuries suffered, any ongoing symptoms, the financial value of the claim and the approach of the defendants.

Time limits in which to bring a claim
- You can choose to begin your investigations into a claim at anytime, subject to still being in time to commence court proceedings.
- The usual rule is for the commencement of any court proceedings in respect of a claim by no later than three years from the date of the incident causing the injuries or three years from the date the person bringing the claim first became aware of the injury.
- There are a number of exceptions to this general rule, including any claims involving children and mentally incapacitated individuals.
